Jive Studios Pty Ltd ACN 681 281 229 (Hobbimate, we, us, our) are committed to complying with the applicable privacy laws in relation to any personal information we collect about our Hobbimate fans (that's you). Please take a moment to read our Privacy Policy as it explains how we collect, manage and disclose your personal information and your rights in relation to any of your personal information that we hold about you.

We provide a safe and inclusive environment to our Hobbimate fans to connect through our mobile application (App) or our website, located at www.hobbimate.com.au (Website). Sometimes, we might ask you to provide additional personal information for specific reasons or ask your permission to use your personal information in unique ways that is not covered in this Privacy Policy. If this happens and those specific disclosures differ from this Privacy Policy, those specific terms will apply. We also reserve the right to use any exceptions or exemptions allowed by applicable privacy laws when handling your information.

Key Definitions

In this Privacy Policy:

  • "APPs" means the Australia Privacy Principles set out in the Privacy Act;
  • "personal information" has the meaning set out in the Privacy Act, and (in summary) means information or an opinion about an identified individual or an individual who is reasonably identifiable, whether true or otherwise;
  • "Privacy Act" means the Privacy Act 1988 (Cth); and
  • "sensitive information" has the meaning set out in the Privacy Act, and includes certain specific types of personal information such as health information, and information about a person's racial or ethnic origin, sexual orientation or practices, criminal record, religious beliefs or affiliations, political opinions, membership of a political, professional or trade association, and biometric and genetic information.

1. How We Collect Your Personal Information

We will collect and hold your personal information in a fair and lawful manner, and not in an intrusive way.

Some of the common ways in which we may receive personal information directly from you include:

  • when you join and create a Hobbimate account on the App or Website, either by typing in your details directly or by linking your details from a third-party social media platform;
  • when you subscribe to us or purchase our goods and services;
  • in administering and performing any contracts with our service providers;
  • when you contact us via telephone, email us, write to us on social media or write to us by other means;
  • when you upload content to the App or Website or interact (in an identifiable manner) with the App or Website;
  • while conducting customer satisfaction and market research surveys;
  • when operating any of our services; and
  • as otherwise required to manage our business.

Where we can, we will usually collect your personal information directly from you. Sometimes, we might collect your personal information from publicly available sources and third parties, such as suppliers, recruitment agencies, your employers, contractors, our clients, business partners, referees, government bodies (e.g. police checks, if required) or professional bodies (e.g. to validate details and currency of qualifications).

If we collect personal information about you from a third party, we will do our best to ask that third party to inform you that we have such information and how we will use and disclose it, and that you can contact us at any time to gain access to and correct and update the information if you need to.

2. Types of Personal Information We Collect

The types of personal information we collect about you depends on the situation. Usually, we will ask for details, including (but not limited to), your name, age, address, email, phone number, your interests and skills, a picture for your profile picture and/or your relationship status.

If you choose to:

  • use certain features of the App (for example, direct messaging or message boards), your information may be seen by other users as part of those features. Please carefully consider what information you choose to share and post.
  • accept our use of cookies on your device, we may collect additional information about your use of our App and Website, such as your internet protocol (IP) address, device information, browser information, and details on your usage. Please see section 7 'Cookies' below for further details; and
  • provide us with permission to access your device location when using our App or Website, we may collect information about your geographical location.

If we need to:

  • confirm your identity, we may collect a copy of appropriate identification.
  • email you, we may use technology that tells us if you have opened it or clicked on any links.
  • collect sensitive information about you, we will only do so with your consent, or otherwise in accordance with the Privacy Act. The main types of sensitive information we may collect include: details of injuries (i.e. health information); details of disabilities or allergies; biometric information; details of an individual's membership of professional associations; and criminal record details as part of pre-employment checks.

If you do provide sensitive information to us for any reason, you consent to us collecting that information and to us using and disclosing that information for the purpose for which you disclosed it to us and as permitted by the Privacy Act and other relevant laws.

If you decide not to share your personal information or sensitive information with us, we may not be able to provide you with requested goods or services and/or certain features or functionality of our App or Website.

3. Our Purposes for Handling Your Personal Information

As a general rule, we only process personal information for purposes that would be considered relevant and reasonable in the circumstances. We may use or disclose your personal information:

  • for the purposes for which we collected it (and related purposes which would be reasonably expected by you);
  • for other purposes to which you have consented; and
  • as otherwise authorised or required by law.

Some of the specific purposes for which we may collect, hold, use and disclose personal information are as follows:

  • to offer and provide you with access to our App or Website;
  • to consider you for a job (whether as an employee or contractor) or other relationships with us;
  • to operate, monitor, develop and improve our App and Website;
  • to confirm your identity;
  • to optimise and customise the Hobbimate experience (including content and advertising) for users;
  • to display information about you, such as your name, profile photo and interests or skills;
  • to facilitate communications via our App, including with other Hobbimate fans via direct messaging and posting to forums;
  • where you have provided us with access to your geo-location, we may send you push notifications for purposes of notifying you of direction messages or matches with other Hobbimate fans;
  • to contact you for marketing purposes (including direct marketing and internet-based targeted advertising);
  • to obtain your feedback and to find out your level of satisfaction with the Hobbimate app;
  • to address any issues or complaints that we or you may have; and
  • to comply with our legal and regulatory obligations.

4. Who We Disclose Your Personal Information To

We may share your personal information with other third parties for the reasons we explained above. These third parties could be:

  • our suppliers, contractors and organisations that provide us with technical and support services or who manage some of our business functions;
  • our accountants, insurers, lawyers, auditors and other professional advisers;
  • any third parties to whom you have directed or permitted us to disclose your personal information (e.g. referees);
  • in the unlikely event that we or our assets may be acquired or considered for acquisition by a third party, that third party and its advisors; and
  • debt collection agencies.

We may also share your personal information if you give us permission, or where disclosure is authorised, compelled or permitted by law. If you post information in public areas of the App or Website, you acknowledge that anyone using the Hobbimate app may be able to see it.

5. Storage and Protection of Personal Information

We work hard to protect your personal information from misuse and loss and from unauthorised access, modification or disclosure. We store your personal information securely, either physically and digitally on our intranet system, in cloud storage, and in some cases, as records on third party servers, which may be located overseas.

We use a range of security measures to keep your personal information safe, including by implementing IT security tools to protect our electronic databases.

When we no longer need your personal information or we are not required to keep it by law, we will either destroy it or de-identify the information. If you think there has been a problem with your personal information, please contact us on the details in section 15.

6. Device Location

We may seek your consent via an in-app message to access information about your device's geographical location in order to show you nearby users and activities within the App within a set radius (e.g., within 100 km of your device's location). We only access your device's location when you are actively using the App and request the minimum geographical information necessary to determine your device's location.

We collect your geographical location to calculate the distance between you and other users, but information relating to your geographical location is not stored in our databases, logs, or third-party services. We also do not track your device's location when you are not using the App, send you push notifications based on your device's location, or share your device's location with any third-party analytics, advertising, or audience-targeting services.

Our access to your device's location information is optional and you can use the App without sharing your device's location. You may disable your device's location settings on your own device. However, doing so will limit certain functionalities of the App, such as the nearby-user experience.

7. Our Marketing and Advertising Activities

We may reach out to our customers in different ways, such as by phone or email. If you would rather not receive our messages, please let us know by contacting us on the details in section 15.

We may also use online targeted advertising to show you ads that might interest you on websites, apps and social media platforms across the internet. These online targeted advertising services are operated by third party vendors, such as Facebook, Instagram or Google.

8. Cookies

A cookie is a small text file stored in your computer's memory or on your hard disk for a pre-defined period of time. We use cookies to identify specific machines in order to collect aggregate information on how visitors are experiencing the Website. This information will help to better adapt the Website to suit personal requirements. While cookies allow a computer to be identified, they do not permit any reference to a specific individual.

We may use third party vendors to show our ads on sites on the Internet and serve these ads based on a user's prior visits to our App or Website.

Our App and Website may contain links to other websites that we do not control. We make no representations or warranties in relation to privacy practices of any third-party website and we are not responsible for the privacy policies or the content of any third-party website. Those other websites are responsible for their own privacy practices. We cannot guarantee how they will handle your information, so please check out their privacy policies before sharing any personal details.

10. Social Media Platforms

We are active on social media platforms such as Facebook, Instagram, X and TikTok to keep you updated about our services. When you interact with us there, we may collect the information that you choose to share with us through these platforms, including photos, videos and comments and posts.

These social media platforms have their own privacy policies, and may handle your information for their own purposes. If you would like to contact us directly, please refer to our contact details in section 15.

11. Accessing and Correcting Your Personal Information

If you believe that your personal information or sensitive information that we hold about you is out-of-date, incomplete, inaccurate, irrelevant or misleading, then you may request that we correct it at any time. If you wish to request access to, or correction of, your information please contact us at the contact details in section 15. We may seek to recover from you reasonable costs incurred for providing you with access to the personal information we hold about you.

There may be rare occasions when we cannot give you access to such information (which we will only do in accordance with applicable laws). If this happens, we will provide you with a written notice stating our reasons for refusing access.

We will respond to all requests for access to or correction of personal information within a reasonable time.

12. Overseas Transfers of Personal Information

Some of the third parties to whom we disclose personal information may be located outside Australia. The countries in which such third party recipients are located depend on the circumstances.

By providing your personal information to us, you consent to us disclosing your personal information to any such overseas recipients for purposes necessary or useful in the course of operating our business, and agree that APP 8.1 will not apply to such disclosures.

Whenever we transfer your personal information outside of Australia, we will do so in accordance with the requirements of applicable privacy and data protection laws.

We collect information in relation to employees as part of their job application and during the course of their employment, either from the employee directly or, in some cases, from third parties such as recruitment agencies, referees, government bodies (e.g. police checks, if required) and academic and professional bodies (e.g. to validate details and currency of qualifications).

The information we collect may include contact details, qualifications, resume, current and former employment details, pay rate and salary, bank details, feedback from supervisors, training records and logs of the employee's usage of our equipment.

Under the Privacy Act, personal information about a current or former employee may be held, used or disclosed in any way that is directly connected to the employment relationship. We handle employee information in accordance with legal requirements and our applicable policies in force from time to time.
